Grievance Process
ADMINISTRATIVE PROCEDURES FOR GRIEVANCES UNDER TITLE II OF
THE AMERICAN WITH DISABILITIES ACT
The City of Wood River’s policy is to eliminate barriers to
ensure equal access to services, programs and activities
provided by the City. The City invites suggestions and will
make every good faith effort to eliminate problems. When this
does not bring a satisfactory result, or if an individual
doesn’t want to work informally, the formal complaint process
is as follows:
Section 1.
Any person who has a grievance against the City of Wood River
regarding alleged violations of Title II, (Subpart A) of the
American with Disabilities Act (the “ACT”), shall submit the
following information in writing to the ADA Coordinator, as
follows:

- The complainant’s name, address and phone number;
- The relationship of the complainant to the City;
- The basis of the complaint;
- The provisions of the Act and implementing regulations
allegedly violated;
- Date(s) of alleged violation;
- The remedy or relief sought.
Section 2.
Upon receipt of the grievance, the ADA Coordinator shall
contact the complainant within fifteen (15) calendar days to
arrange a conference with the complainant. The ADA Coordinator
shall thereafter review the allegations of the complaint to
the extent necessary to properly address and act on the
complaint.
Section 3.
The ADA Coordinator shall notify the complainant in writing,
and where appropriate, in a format accessible to the
complainant, such as large print, Braille, or audio tape,
within fifteen (15) calendar days following the conference of
what, if any, action has been or will be taken regarding
continued review of the complaint.
Section 4.
If the response by the ADA Coordinator does not satisfactorily
resolve the issue, the complainant and/or his/her designee may
appeal in writing to the Wood River City Council. The Council
shall review the appeal within thirty (30) calendar days of
receipt of the same and notify the complainant of its
concurrence or rejection of the ADA Coordinator’s decision in
writing, and, where appropriate, in a format accessible to the
complainant, with a final resolution of the complaint,
including any alternate resolution it wishes to implement.
All written complaints received by the ADA Coordinator,
appeals to the City Council and responses will be retained by
the City of Wood River for at least three years.
